PERSONAL DATA PROTECTION DISCLOSURE TEXT REGARDING COOKIES

1. Introduction

This Personal Data Protection Disclosure Text Regarding Cookies (hereinafter referred to as the “Disclosure Text”) has been prepared by Deniz Bersu Mert Attorney Partnership (“DBM Attorney Partnership”), acting in the capacity of data controller, located at Sahrayıcedit Mah. Atatürk Cd., Mesa Koz No:69 D:50, Kadıköy/İstanbul, Tax Office: Erenköy, Tax No: 2912054195, within the scope of Article 10 of the Personal Data Protection Law No. 6698 (“Law”) and the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform.

As DBM Attorney Partnership, we benefit from certain technologies (“cookies”) in order to improve your experience during your use or visit of the website www.dbmhukuk.av.tr (“Site”). The use of these technologies is carried out in compliance with the Law and all legislation to which we are subject.

The purpose of this Disclosure Text is to inform you about which personal data are processed through cookies used during access to the Site, for which purposes and legal grounds they are processed, which types of cookies are used on the Site, and how you can control these cookies.

As DBM Attorney Partnership, we may discontinue the use of cookies used on the Site where necessary, change their types or functions, or add new cookies to the Site. Accordingly, we reserve the right to amend the provisions of this Disclosure Text at any time, provided that it is published on the Site in advance and the necessary disclosure is made. Any changes made to the current Disclosure Text shall enter into force upon publication on the Site. You can find the last update date at the end of the text.

2. What is a Cookie?

Cookies are small text files stored on the visitor’s device (for example, computer or phone) when a website is visited and that may contain data in name-value format. These text files can be interpreted by browsers and servers that can access them, and in this way various information can be obtained about the device on which the website visit is carried out and consequently about the relevant user.

3. What Are the Types of Cookies?

3.1. Types of Cookies According to Duration of Use

3.1.1. Session Cookies (Temporary)
A session cookie, also referred to as a temporary cookie, is used to ensure continuity of the session. When the user closes the internet browser, session cookies are also deleted.

3.1.2. Persistent Cookies
A persistent cookie that is not deleted when the internet browser is closed is automatically deleted on a certain date or after a certain period. Through this cookie, whenever a user visits a website, the processed data of the user are transmitted to the server. They may also be used to ensure that users do not have to re-enter login information each time they log into their accounts on websites. Within this framework, session cookies and persistent cookies are used on our website according to their duration of use.

3.2.1. First-Party Cookies
Cookies placed directly by the Site.

3.2.2. Third-Party Cookies
Cookies placed by a domain outside the Site. Within this framework, first-party and third-party cookies are used on our website.

3.3. Cookies According to Their Purpose of Use

3.3.1. Mandatory Cookies
These are the types of cookies that enable the Site to perform its basic function and become usable. These cookies are first-party cookies and process personal data during the session (except for cookies related to your privacy preferences, as these cookies have a longer lifespan than the session), and are automatically deleted when the session ends. These types of cookies allow you to navigate on the Site. If these types of cookies are blocked, some features of the Site may not be usable.

3.3.2. Performance and Analytics Cookies
Cookies are used to determine the number of users visiting the Site. These cookies are cookies placed by our advertising partners through the Site and are third-party cookies. These cookies are used by our business partners to create your profile according to your interests and to show you relevant advertisements.

Within this framework, mandatory, performance and analytics, functional, advertising and marketing cookies are used on our website.

4. Which Types of Cookies Are Used for Which Purposes?

As DBM Attorney Partnership, we use cookies on the Site for various purposes and process your personal data through these cookies. These purposes are mainly as follows:

4.1. Mandatory Cookies are used to perform the basic functions necessary for the operation of the Site and to fulfill the information society service you have requested (logging in, filling out forms and remembering privacy preferences, counting visitors on our website and measuring traffic).

4.2. Performance and Analytics Cookies are used to determine the number of users visiting the Site, to detect errors encountered by our visitors on the Site, to determine which areas of the Site need improvement, to determine which areas of the Site are most visited and how long users stay on the Site.

4.3. Functional Cookies are used to make the Site more functional and personalized (ensuring that your preferences other than your privacy preferences are remembered when you re-enter the site).

4.4. Advertising and Marketing Cookies are used by our business partners to create your profile according to your interests and to show you relevant advertisements.

5. Method and Legal Basis of Collecting Personal Data

Your personal data are collected automatically (without human intervention) through cookies.

5.1. Your personal data collected through Mandatory Cookies are processed within the scope of subparagraph (c) of paragraph (2) of Article 5 of the Law, “Provided that it is directly related to the establishment or performance of a contract, it is necessary to process personal data belonging to the parties of the contract” or subparagraph (f) “Provided that it does not harm the fundamental rights and freedoms of the data subject, it is necessary for the legitimate interests of the data controller”.

5.2. Your personal data collected through Performance and Analytics, Functional, Advertising and Marketing Cookies are processed by obtaining your explicit consent within the scope of paragraph (1) of Article 5 of the Law.

6. Transfer of Personal Data Collected Through Cookies

Your personal data collected through cookies may be transferred, for the purposes stated under the heading “Which Cookies Are Used for Which Purposes?”; within the scope of our legitimate interest to service providers providing information technology infrastructure and technical services related to cookies located domestically, and to legally authorized public institutions and legally authorized private organizations where explicitly stipulated by laws and within the scope of fulfilling our legal obligations.

Pursuant to the purposes explained above, if you allow third-party cookies located abroad, your personal data are transferred abroad within the scope of Article 9 of the KVKK based on appropriate safeguards due to these service providers obtaining their server services from abroad.

In addition, your personal data (identifier, device data) processed through the use of Google Analytics cookies are transferred to Google LLC located abroad for the purpose of reporting by analyzing user behavior on the Site, and to Meta Inc. located abroad for the purpose of presenting personalized advertisements to users, based on appropriate safeguards within the scope of Article 9 of the KVKK.

Below are the types of cookies used on the Site and their general purposes. The names and retention periods of the cookies may change due to updates in our systems; in such cases, the up-to-date list may be provided to you separately upon request.

9. What Are Your Rights as a Data Subject?

Pursuant to Article 11 of the Law, data subjects have the right to:

  • Learn whether personal data are processed,
  • Request information regarding personal data if processed,
  • Learn the purpose of processing of personal data and whether they are used in accordance with their purpose,
  • Know the third parties to whom personal data are transferred domestically or abroad,
  • Request correction of personal data if processed incompletely or incorrectly and request notification of such correction to third parties to whom personal data have been transferred,
  • Request deletion or destruction of personal data if the reasons requiring processing cease to exist despite being processed in accordance with the KVKK and relevant legislation and request notification of such process to third parties to whom personal data have been transferred,
  • Object to the occurrence of a result against the person himself/herself by analyzing the processed data exclusively through automated systems,
  • Request compensation for the damage in case of suffering damage due to unlawful processing of personal data.

10. Application Procedure

Regarding your personal data processed through cookies used on the Site, you may submit your requests within the scope of Article 11 of the Personal Data Protection Law, pursuant to Article 5 of the Communiqué on the Procedures and Principles of Application to the Data Controller dated 10 March 2018, by filling out the “Data Subject Application Form” that you may access here;

  • You may deliver the application form signed with a wet signature together with documents identifying your identity by personally coming to Sahrayıcedit Mah., Atatürk Cd., Mesa Koz No:69 D:50, Kadıköy/İstanbul, or send it to the specified address by registered mail with return receipt or via notary public,
  • By signing this Application Form with a “secure electronic signature” defined in the Electronic Signature Law No. 5070 and sending it to info@dbmhukuk.com,
  • By filling out and signing this Application Form and uploading the wet-signed form to the computer by scanning it and sending it via e-mail to info@dbmhukuk.com (in case this method is preferred, a document verifying identity must also be attached to the e-mail),
  • By signing with a “secure electronic signature” defined in the Electronic Signature Law No. 5070 and sending it via the KEP system to mert.metin.01@hs01.kep.tr.

In applications to be made, it is mandatory that the request be made in Turkish; that it be written with clarity so that it can be understood without hesitation which of the rights listed above and in Article 11 of the KVKK the request is based on; and that identity information and documents and information related to the subject be attached to the application. In applications to be made on behalf of third parties, a power of attorney suitable to represent the relevant person must be available.

Applications made within this scope will be concluded free of charge as soon as possible and at the latest within 30 days. However, if the process requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board may be requested from you.

If the information and documents submitted are incomplete, this period starts from the date on which the information and documents are fully submitted. Our Company has the right to verify your identity before responding to you.

Responses may be sent in writing to the applicant’s address by any type of mail or to the KEP/e-mail address you have notified, at the discretion of DBM Attorney Partnership.

DBM Attorney Partnership reserves the right to amend this disclosure text due to possible amendments in the KVKK and methods to be determined by the Personal Data Protection Board.
